THE DIGITAL DILEMMA: UNVEILING THE BROADCASTING BILL 2023

The Ministry of Information and Broadcasting (MIB) took a significant step by unveiling the Broadcasting Services (Regulation) Bill, 2023, on November 10. This draft legislation, open for public consultation until December 9, introduces sweeping changes that extend regulatory oversight to encompass Overthe-Top (OTT) content and digital news, sparking concerns about the potential impact on online free speech and journalistic freedom.

THE BILL

The Broadcasting Bill, presented as a replacement for the Cable Television Networks (Regulation) Act, 1995, and other existing guidelines, responds to the evolving needs of the broadcasting sector amid technological advancements. This comprehensive legislation, encapsulated in six chapters, 48 sections, and three schedules, proposes a paradigm shift.

OTT PLATFORMS UNDER SCRUTINY

Of particular note is the bill's expansion of regulatory coverage to include OTT content and digital news. The term "internet broadcasting networks" encompasses a range of technologies, from Internet Protocol Television (IPTV) to OTT broadcasting services like Netflix and Disney Hotstar. However, the bill makes a critical distinction, excluding social media intermediaries from the definition of OTT broadcasting services.
